Virginia Amends Nonjudicial Foreclosure Notice of Sale Requirements

Virginia passed a bill amending Notice of Sale requirements under the nonjudicial foreclosure process. Under the bill, if a lender or servicer has received notification that the owner of the property is deceased, the Notice of Sale must be personally delivered or mailed to: the last known address of the owner; any personal representative of the deceased’s estate whose appointment is recorded among the records of the circuit court where the property is located; and any heirs of the deceased that are listed on the list of heirs recorded among the records of the circuit court where the property is located. The bill becomes effective July 1, 2018.
