Virginia passed a bill amending foreclosure Notice of Sale requirements for owner-occupied properties. Under the bill, a Notice of Sale must now be provided at least 60 days prior to the foreclosure sale of a property (previous requirement was 14 days prior to the foreclosure sale of a property). The bill also requires additional content to be included in the Notice of Sale, relating to the last payment received, the amount owed, and available resources for assistance. In addition, the bill requires an affidavit to the trustee affirming delivery of the Notice of Sale to the owner of the property. The bill becomes effective July 1, 2021.
