Utah Amends Cancellation of Notice of Default Mailing Requirements

Utah passed a bill amending mailing requirements with respect to a Cancellation of Notice of Default. Under the bill, if a default is cured and the trust deed is reinstated, the trustee must mail a copy of the recorded Cancellation of Notice of Default to each person entitled to receive a copy of the notice of default and the notice of sale. The Cancellation of Notice of Default must be mailed within 20 days and must be sent by certified or registered mail, return receipt requested with postage prepaid. The bill becomes effective May 4, 2021.
