Texas Amends Security Breach Disclosure Requirements

Texas passed a bill amending security breach disclosure requirements. Under the bill, a lender, broker or servicer must notify the attorney general of a breach of security as soon as practicable, but no later than the 30th day after determining that a breach involving at least 250 Texas residents occurred (previously no later than the 60th day). The bill also requires a lender, broker or servicer to notify the attorney general electronically using a form accessed through the attorney general’s internet website. The bill becomes effective September 1, 2023.
