South Dakota passed a bill authorizing the online notarization of documents and establishing procedures for the performance of online notarizations. An online notarization is defined as a notarial act performed by means of an electronic device or process that allows a notarial officer and a person not in the physical presence of the notarial officer to communicate with each other simultaneously by sight and sound.
