South Dakota passed a bill authorizing the electronic notarization of documents and establishing procedures for the performance of electronic notarizations. An electronic notarization is defined as a notarial act performed by means of an electronic device or process that allows a notarial officer and a person not in the physical presence of the notarial officer to communicate with each other simultaneously by sight and sound. The bill becomes effective July 1, 2024.
