New Jersey Requires Lenders and Servicers to Provide Property Deed following Foreclosure Sale

New Jersey passed a bill requiring a foreclosing lender or servicer’s attorney to provide the property deed to the Sheriff following a foreclosure sale. Under the bill, following a foreclosure sale, the foreclosing lender or servicer’s attorney must prepare and submit the property deed to the Sheriff’s office for execution. The bill also mandates the form of the deed. In addition, the bill revised the time within which a foreclosure sale must be held, and  amended requirements with respect to the postponement of a foreclosure sale. The bill becomes effective July 28, 2019.
