New Jersey Expands Certification of Diligent Inquiry Requirements in Residential Mortgage Foreclosure Actions

New Jersey passed a bill expanding certification of diligent inquiry requirements in residential mortgage foreclosure actions. Under the bill, an attorney filing a foreclosure complaint in a residential mortgage foreclosure action must include a certification of diligent inquiry. The bill mandates the content of the certification. The bill codifies, and expands upon, the certification of diligent inquiry requirements set forth in court rules. The bill went into effect January 10, 2022, and applies to all residential mortgage foreclosure actions filed after that date.
