Michigan Amends Content of Notice of Foreclosure by Advertisement

Michigan passed a bill amending the content of the notice of foreclosure by advertisement (Notice). Under the bill, a lender or servicer must now include in the Notice the street address of the property, the contact information of the foreclosing attorney; and a “Notice of foreclosure by advertisement” statement (Michigan has mandated the exact language to be used).

The Notice must also include a statement directed to active duty military service members if the foreclosure involves a residential mortgage (Michigan has mandated the exact language to be used).

The bill becomes effective January 11, 2020.
