Illinois passed a bill permitting foreclosure sales to be held in person, online, or both. Under the bill, a sheriff or other person selected by the court may hold a foreclosure sale in person, online, or both. A foreclosing lender or servicer may request that the foreclosure sale be held in person, online or both. The bill also requires a notice of sale to include a statement informing homeowners whether the sale will take place in person, online, or both, and, if applicable, the website where online bidding may take place. In addition, in the event of the postponement of a foreclosure sale, the bill permits a sheriff or other person conducting the foreclosure sale to post on the sheriff or other person’s website the date, time, and place on which the postponed foreclosure sale is to be held. The bill becomes effective January 1, 2025.
