Hawaii Amends Secure and Fair Enforcement for Mortgage Licensing Act

Hawaii passed a bill amending the Secure and Fair Enforcement for Mortgage Licensing Act. Under the bill, an exempt sponsoring mortgage loan originator company must maintain a principal place of business in Hawaii and designate a qualified individual to manage and supervise the mortgage loan origination activities of the company. The bill also requires applicants for a mortgage loan originator company and mortgage loan originator license to pay a criminal background check fee in the amount charged by the entity conducting the background check (rather than a flat $35 criminal background check fee). The bill went into effect September 1, 2017.
