Freddie Mac Issues Bulletin 2017-6: Servicing Updates

Freddie Mac issued Bulletin 2017-6 (Bulletin), announcing updates to Freddie Mac’s servicing requirements. The Bulletin announces servicing updates in response to the CFPB’s recent amendments to the 2013 Mortgage Servicing rules under the Real Estate Settlement Procedures Act and the Truth in Lending Act. The servicing updates relate to: borrower contact prior to a foreclosure sale; acknowledging receipt of borrower response packages; the definition of “first complete borrower response package”; and repayment plans. The Bulletin also announces updates with respect to follow-up communications with borrowers nearing the completion of short-term unemployment forbearance plans. The Bulletin generally went into effect May 10, 2017. However, the updates related to the CFPB’s amended Mortgage Servicing rules become effective October 19, 2017.
