FHA Conditionally Extends Hurricane Maria Foreclosure Moratorium for Properties Located in Puerto Rico and the Virgin Islands

FHA conditionally extended the foreclosure moratorium for properties located in Puerto Rico and the Virgin Islands affected by Hurricane Maria. To qualify for the conditional extension: the borrower must not have been more than 60-days past due as of the date of the disaster and must not have been previously approved for a forbearance or other loss mitigation option. With respect to borrowers that qualify for the conditional foreclosure moratorium, lenders and servicers must, on or before July 18, 2018, assess the condition and habitability of the property, and have the borrower complete and execute all required documents for approved loss mitigation options. If these conditions are met, the foreclosure moratorium must be extended until August 16, 2018 (the foreclosure moratorium was previously set to expire May 18, 2018).
