Fannie Mae issued Servicing Guide Announcement SVC-2022-05 (Announcement), setting forth updates to the Servicing Guide. Per the Announcement, Fannie Mae:
- added requirements for compliance with state Safe at Home Laws (aka Address Confidentiality Programs), including a requirement to notify Fannie Mae of a borrower enrolled in an Address Confidentiality Program and in the instance of a post-delivery servicing transfer, a requirement that the transferor servicer provide notice of a borrower’s enrollment in an Address Confidentiality Program and the legal substitute mailing address to the transferee servicer;
- incorporated the previously communicated Stop Delinquency Advance process and Guaranty Relief process; and
- clarified that the Loss Mitigation mailbox is the appropriate contact for the servicer to obtain Fannie Mae’s approval for any suspension of a foreclosure action beyond 60 days to facilitate the processing of assistance from a mortgage assistance fund program provider.
Revisions related to the Address Confidentiality Program are effective September 1, 2022 (servicers are, however, encouraged to implement the changes July 13, 2022). All other updates are effective July 13, 2022.
