CFPB Amends Fair Credit Reporting Act with respect to Medical Information

The CFPB adopted rules amending the Fair Credit Reporting Act (FCRA) with respect to medical information. Per the rule adoption, the CFPB removed an exception that permitted creditors to consider medical information in credit eligibility determinations. In addition, the CFPB added a prohibition that generally prohibits a consumer reporting agency from furnishing to a creditor a consumer report containing information on medical debt that the creditor is prohibited from using. The rule adoption becomes effective March 15, 2025.
