California Amends Notice of Sale Requirements for Nonjudicial Foreclosures

California passed 2 bills amending Notice of Sale requirements for nonjudicial foreclosures. Under the bill, a Notice of Sale pertaining to 1-to 4- family real property must contain a Notice to Tenant. The Notice to Tenant informs any tenants of the right to purchase the property following the foreclosure sale and the steps to take to exercise such right. The bills also amend requirements with respect to the publication of a Notice of Sale in the newspaper. In addition, the bills amend nonjudicial foreclosure provisions with respect to: the bundling of properties for the purpose of sale; bidding at a foreclosure sale; and civil penalties for failure to maintain vacant residential property purchased at a foreclosure sale. The bills become effective January 1, 2021. The amended provisions have a sunset date of January 1, 2026.
