Arizona adopted a rule permitting employees (including loan originators) to work at remote locations. Under the adopted rule, a mortgage banker licensed under the Mortgage Bankers Statute and a broker licensed under the Mortgage Brokers Statute may allow employees (including loan originators) to work at a remote location if:
- A mortgage banker or mortgage broker has written policies and procedures for supervision of employees working from their residence or a location other than a licensed location;
- Access to company platforms and customer information are in accordance with the mortgage banker’s and mortgage broker’s comprehensive written information security plan; and
- Physical records are not maintained at a remote work location.
“Remote work location” means a location at which the employees (including licensed loan originators) of a licensee may conduct licensed activities other than the principal place of business or branch office.
The bill becomes effective April 6, 2025.
