FHA Clarifies Eligibility Requirements for Non-Permanent Resident Borrowers

FHA issued Mortgagee Letter 2021-09, clarifying eligibility requirements for non-permanent resident borrowers. Per the Mortgagee Letter, FHA:

  • Clarified eligibility requirements for individuals participating in the Deferred Action for Childhood Arrivals (DACA) program; and
  • Eliminated the requirement to obtain an Employment Authorization Document (EAD) for non-permanent resident borrowers who are citizens of the Freely Associated States (FAS), maintain lawful H-1B nonimmigrant status, and who have demonstrated stable employment.

The updates are effective with case numbers assigned on or after July 26, 2021 (lenders may, however, implement the changes immediately).
