Montana Authorizes Remote Online Notarizations

Montana passed a bill authorizing the remote online notarization of documents and establishing procedures for the performance of online notarizations. A remote online notarization is defined as a notarial act performed by means of an electronic device or process that: allows a notarial officer and a remotely located individual to communicate with each other simultaneously by sight and sound; and when necessary, facilitates communication with a remotely located individual with a vision, hearing or speech impairment. The bill went into effect October 1, 2019.
