Georgia Amends Power of Attorney Act

Georgia passed a bill amending the Power of Attorney Act (PAA). Under the bill, persons who witness or who acknowledge (e.g., notary publics) the execution of a power of attorney may not be named as an agent in the power of attorney. The bill also amends the content of the Statutory Form Power of Attorney. In addition, the bill amends requirements with respect to co-agents and successor agents, acceptance of an acknowledged power of attorney, termination of a power of attorney, and exemptions from the PAA. The bill becomes effective July 1, 2018.
